A. Prohibitions

It is assur mid’oraysa[1] רמב"ן מנה מצוה לזכור את אשר עשה ה' למרים (וגם לזכור את אשר הקצפת את ה' במדבר). וע' ספר חפץ חיים (פתיחה) כמה עשין ולאוין שיכול לעבור ע"י לשון הרע. to tell someone (Reuven) anything negative about someone else[2] הל' לשה"ר (א, א). ובין אם הוא איש או אשה, קטן או גדול, רחוק או קרוב (הל' לשה"ר ח, א-ג). (Shimon), or to listen to someone else say lashon hara[3] הל' לשה"ר (ו, א) . It is forbidden even if what is said is true, but if it is false, one has violated a more serious transgression, known as motzee shem ra[4] הל' לשה"ר (א, א) .

It is forbidden to say it behind his back or in his presence[5] הל' לשה"ר (ג, א) . It is forbidden even if it is said as a joke and without malice[6] הל' לשה"ר (ג, ג). ולענין דיבור צחות, ע' שו"ת מהרי"ט (יו"ד טז). , and even if the speaker would say it to Shimon himself. However, if the statement has two possible implications, and is not necessarily negative, he may say it if he is certain that he would not refrain from saying it in front of Shimon, because he knows he is not implying anything negative[7] הל' לשה"ר (ג, ב) .

One may not say a negative comment about another, whether about his physical qualities, a sin he committed, or any other aspect[8] בין דבר שהוא לאו גמור או עשה גמורה, שבודאי יתבזה מאד לפני השומע ע"י ספורו, ואפי' אם הוא דבר שאין נזהרין בזה הרבה מהמוני ישראל (הל' לשה"ר ד, ב). . One may not even say a comment which, about most people, would be a compliment, if for that person, it is negative. For example, one may not say, “That guy learns Torah for four hours a day,” even though the speaker himself cannot learn for that much time, if it is less than one would expect that person to learn[9] הל' לשה"ר (ה, ו) . One is permitted to speak of someone in a way which, considering his age and/or situation, is not negative. For example, one may say of a three-year-old that he threw a tantrum in public, but not of a twelve-year-old. One may say of a financially strapped person that he donates $1,000 annually to his child’s school, but not of a wealthy person whom would seem stingy[10] על פי הנ"ל. .

One may not say lashon hara about anyone, whether he is a child or adult[11] שמה"ל ח, ג , ignorant or learned[12] שמה"ל ח,ד , living or dead[13] שמה"ל ח, ט. וע' אמת ליעקב (פרשת וישב) דמותר לומר לשון הרע על המתים, ורק יש חרם שלא להוציא שם רע על המתים, ומדייק כן מלשון השו"ע (תרו, ג). [ולכאו' כן מוכח מהרבה סיפורים בתנ"ך ובגמ' ומדרשים, שמדברים בגנאי כמה צדיקים ואנשים פשוטים, ופשוט דמותר לספר סיפורים אלו אפי' בלי כונה לתועלת, והוי ראי' שאין איסור לשה"ר לספר על המתים. אמנם אפשר יש לדחות דבודאי הם מחלו על כבודם, כיון דכדאי להם למחול על כבודם כדי לקבל שכר להיות מעשיהם נכללים בדברי תורתינו הקדושה, וצ"ע.] וע' גמ' ברכות (יט.) משמע שאין איסור לספר לשה"ר על המת אא"כ הוא תלמיד חכם. . It is permitted to say lashon hara about those who deny Hashem and His Torah[14] שמה"ל ח,ה-ז. ומצוה לספר עליהם . One may not say that someone is a Baal Teshuva, unless he is saying it to someone who will not view it negatively and will not repeat it to others[15] הל' לשה"ר (ד, א), ע"פ באר מים חיים (שם) .

One may not say lashon hara about others, even if he also denigrates himself at the same time[16] הל' לשה"ר (א, ט) . One may not say lashon hara to his parents[17] הל' לשה"ר א, ה or his spouse[18] שמה"ל ח,י (except when it is permitted due to to’eles; see later).

One may not say anything negative about someone else’s belongings or merchandise, even if it is true (except when there is a to’eles)[19] הל' לשה"ר (ה, ז) .

This prohibition is not limited to speech. It is forbidden show someone pictures, documents, or videos if it will cause the viewer to think worse of someone else[20] הל' לשון הרע א, ח .

One may say a negative story about someone if he does not mention the person involved. However, if the listener will be able to figure out who the person is, it is forbidden to say it[21] הל' לשה"ר (ג, ד) .

If one heard lashon hara, he may not believe it, but he must act cautiously in case it is true[22] הגהות מיי' (דעות, פ"ז או' ד), והל' לשה"ר (ו, י) .

One may not say lashon hara, even if by not saying it, he will suffer financial loss[23] הל' לשה"ר (א, ו) (e.g., his boss asks him for information) or embarrassment[24] הל' לשה"ר (א, ז) (e.g., people will think he is a moron or a frumie).

If one is schmoozing with a group of friends and the topic turns to lashon hara, one should try to change the conversation or excuse himself. If one knows that he will not do so, he should firmly decide that he does not believe any of the lashon hara which they are saying. He also may not show any form of agreement or head-nodding to the lashon hara, and should try not to enjoy listening to the conversation[25] הל' לשה"ר (ו, ה) .

One may not praise Shimon in the presence of Shimon’s enemy, as it may lead to Shimon saying a negative comment regarding Shimon[26] הל' לשה"ר (ט, א), רמב"ם (דעות ז, ד). והוא מיקרי אבק לשון הרע, וד' אבקות הן, אבק לשה"ר, אבק רבית, אבק שביעית, ואבק עבודה זרה (תוספתא ע"ז א, י). ואבק מיקרי כל דבר דלא הוי עיקר האיסור תלוי בו, אלא צד איסור (ע"פ רש"י סוכה מ:). , such as, “You think he’s so great? Let me tell you what he did…”. One also should not praise someone publicly, as there will usually be someone jealous in the crowd, who will try to limit the praise by saying something negative[27] הל' לשה"ר (ט, ב) .

It is assur mid’oraysa[28] ספר המצות לרמב"ם (ל"ת שא), חינוך (מצ' רלו) to tell someone (Reuven) anything which someone else (Shimon) did negatively towards him, because it will cause animosity between them. It is forbidden even if what is said is completely true[29] רמב"ם (דעות ז, א-ב) , and even if Shimon would not deny it if he was asked about it. It is forbidden even if the speaker believes that what Shimon did was justified, if he suspects that Reuven may view it negatively[30] הל' רכילות פ"א . This sin, according to many, is worse than lashon hara, and it causes more strife and fighting[31] ראב"ד (השגות על רמב"ם, דעות ז, ב), וכן משמע ברש"י (ערכין טו:) .

One may not even say, “I can’t say what Shimon did”, because it implies a negative. One may not say, “who would have guessed in Shimon’s younger years that he would be where he is today?”, as this also implies a negative[32] הל' לשה"ר (ט, א) .

One may not repeat anything which was told to him, unless the speaker told him that he is permitted to repeat it[33] גמ' יומא (ד:), והו"ד במג"א (סי' קנו). ולענין רופא שיודע דבר בנוגע לחולה, ודבריו נאמרו בסתר, או מוכח מתוך הענין שאינו רוצה שרבים ידעו מזה, ע' שו"ת צי"א (חל' יג ס' פא). , or it is clear that the speaker would not mind if it was repeated[34] פשוט .

B. Permitted Cases

One is permitted to listen to lashon hara if he needs to know it for a specific reason, such as before entering a shidduch or business agreement with that person, or before advising someone else to make a shidduch with that person. Even though one is permitted to listen to it, and even ask for information, one may not believe that what he hears is true, and may only be wary of the possibility it is true[35] הל' לשה"ר (ו, ב) . If one’s friend approaches him and wants to talk to him about what someone else did, he must first ask if there is some possible benefit to be gained by knowing this information, and if there is not, he may not listen[36] הל' לשה"ר (ו, ג) .

One also may listen to lashon hara if he estimates that he may be able to convince the speaker that what the person did was not bad or incorrect[37] הל' לשה"ר (ו, ד) .

One may say lashon hara if it serves a positive purpose (to’eles). There are several valid forms of to’eles when it comes to saying lashon hara:

1) Preventing bad decisions: It is permitted to say a statement to help someone stay away from making a bad decision. For example, one may warn someone to be wary of doing business with a potential employer. Before saying lashon hara for this reason, one must ensure the following conditions are met:[38] הל' לשון הרע (י,ב)

a. One may not rush to judgement to decide that what he saw or heard was truly negative or forbidden. This applies even if the speaker saw it directly.

b. One may not exaggerate the sin, even in the slightest manner.

c. The intention must be to achieve a positive goal for the listener, not due to personal dislike of the subject, or for the pleasure of gossiping.

d. It is only permitted if there is no other way of accomplishing this goal. If there is another way, it is forbidden to say lashon hara and the other means must be employed.

e. One may not cause the wrongdoer any more punishment or loss than he would deserve if he would be convicted of his crime in Beis Din.

If all the above conditions are met, one may tell of what he knows, even though it is not known if what he heard is true.

For example, if one knows his neighbor is looking to enter a business deal with someone, he may mention that he heard that person had stolen from his previous business partner. One may not say, “I heard that he stole from several of his former partners”. If he could also negate the deal by convincing his neighbor that there are better deals to be found elsewhere, he must try that method and may not say lashon hara.

2) Helping the wrongdoer do teshuva. By informing various people, one can help a wrongdoer right what was done and/or do teshuva. This includes informing the wrongdoer’s friends of the misdeed, in order that they will pressure him to right the wrong (e.g., return stolen money). It also includes informing higher authorities, such as his Rav or parents, in order that they can help him recognize that he went wrong, and help him do teshuva. In all these cases, the conditions listed above must be met, in addition to the following[39] :

f. One must know what he is saying is true, and not merely a repetition of a rumor that he heard.

g. The wrongdoer must be rebuked before anyone else is told of the misdeed. If he does not change his ways, then someone else may be told.

3) Denigrating wrongdoers. If one is certain that what he is saying is true, and one does not exaggerate, it is permitted to say lashon hara so that others will see how people embarrass and degrade wrongdoers, and they will refrain from doing aveiros[40] הל' לשון הרע (י, ד), עפמ"ש בבאר מים חיים (או' טז) דדוקא כשאין לחשוב עליו שום צד זכות. . Additionally, it is permitted if it is a widespread rumor that he is accused of such wrongdoing, and the information seems to be well-grounded, not merely spread by his enemies[41] רמב"ם (הל' סנהדרין כד, ה), ע"פ גמ' קדושין (פא.) ומגילה (כה:). .

In many cases, one is obligated to say lashon hara if the subject is tricking someone else into doing an action which will harm themselves; a Rav should be consulted. For example, if a boy is seriously ill, and he gets engaged without informing his fiancé of his illness, anyone aware of the situation must consult a Rav as to whether the girl must be informed[42] ע' נשמת אברהם (אה"ע סי' ב) דלכמה פוסקים מחוייב מדינא להגיד אל המשודכת, משום לא תעמוד על דם רעיך. .

One is permitted to tell others lashon hara about himself[43] שמה"ל (באר מים חיים כלל א ס"ק טו). אבל שמעתי מהגר"צ שכטר בשם הגרי"ד סולובייצ'יק, דאסור משום והייתם נקיים, שאם אסור לגרום שאחרים יחשדו אותו, כל שכן דאסור לומר לשון הרע על עצמו. .

Strictly speaking, one is permitted to say lashon hara if three people already know the information he is relaying. It is assur to inform the non-Jewish authorities about a Jew who committed a crime^{^[45]} שו"ע (חו"מ שפח, ט) . However, if he is harming others, it might be permitted^{^[46]} ציץ אליעזר (יט, נב), עפמ"ש רמ"א (שפח, ז-ט), וש"ך (סקמ"ה). ויסוד דבריו, דכל המדובר בשו"ע (שם) באיסור מסירה הוא אם רוצה למסור כדי שינהגו זלזול עם המסור, אבל כשרוצה למסור כדי להציל הנרדף מנזק שבגופו ובנפשו (מדובר שם במורה בגן ילדים שמתעלל בהם), ואין כח ביד בית דין להציל, מותר. וגם, בשו"ע מיירי במדינה שלא היה לאנשים בטחון בגופו ובממונו מפני השודדים ואנסים אף שנשאו עליהם שם משרה, אבל במדינה שלכל אחד יש בטחון בגופו וממונו, אין איסור למסור. והוכיח שם דכן דעת ערה"ש (שפח, ז), ע"ש.

וע' ב"י (שם) בעובדא דר' אלעזר בר"ש (ב"מ פג:), שהיה מוסר אנשים למלכות, כתב ב"י בשם רשב"א שההיתר לעשות כן הוא דהוי ממשפטי המלוכה. ומה שקראו ר' יהושע בן קרחה חומץ בן יין, ע' ב"י (שם) דאע"פ שמותר ע"פ דין, לחסידי עליון וגדולי תורה אין לעשות כן.

וע' אג"מ (חו"מ א, ח) בטבח שזייף חותמות ומכר נבילות בתור כשירות, דכל זמן שיכולים להפסיקו בדיני ישראל אסור ללכת לערכאות של עכו"ם, וחוץ מאיסור מסור עובר גם באיסור הליכה לערכאות של עכו"ם. וכשרואין הבית דין שאינם יכולים להפסיקו, יכול ללכת ברשות בית דין לערכאות.

וע' שו"ע (שפח, יב) ורמ"א שם, דמותר למסור מי שמסכן הרבים.

ובזמן הזה, למסור מי שעבר על חוקי המדינה למשטרה, ע' ש"ך (סק"כ) כ' דאינו חייב לשלם על מסירת חבירו בציור שהוא דינא דמלכותא, כגון אם יש להם חוקים השוים לכל, ולא עשו גזירה במיוחד רק נגד איש זה. [ולפע"ד דלפי סברא זו, הוי אפי' מותר למוסרו לכתחלה בכה"ג.]

[ונלע"ד, דכל הנ"ל מיירי בציור שישימו אותו בכלא או ימיתו אותו, אבל בציור שיהיה עליו רק עונש כספי קטן, ולעומת זה יש צער הרבה לרבים, נראה דהוי בכלל "המיצר הציבור ומצערן" דכתב שו"ע (שפח, יב) דמותר למוסרו, ואפשר שזה שייך במי שחונה רכב שלו במקום שהוא מפריע לרבים, ולעומת זה יקבל עונש כספי קטן, נראה דמותר. ושמעתי עוד ציורים שיש להקל, כגון מי שנהג הרכב שלו ופגע בחבירו ולאיש שהיה אשם הרי יקבל קנס על זה שנהג בדרך לא חוקי, מותר לחבירו למוסרו כדי להציל שלא ינהג עוד. וגם, אם כוונתו רק כדי שיקבל הכסף מן הבטחון ואם לא יתקשר למשטרה לא יתן לו החברת בטחון כסף על הזיקו, כיון שאין כוונתו למסור חבירו אלא שבלי זה לא יקבל כסף הראוי לו מחמת היזק חבירו, מותר כיון שהוא בלא כוונת מסירה כמ"ש רמ"א (שפח, ה), וגם אין בו איסור ערכאות כיון שאי אפשר להוציא הכסף באופן אחר.] , and a Rav should be consulted.
